The Fall of PR-State Government/ 民联州政府的倒台

It is said that two can play the same game.

Since the failure of Anwar to form the federal government on September 16 last year, there have been talks of YBs crossing over from BN to PR or vice versa. Finally, it was the defection of PR state assemblymen to BN that caused the downfall of the Perak PR state government.

The government, both federal and state should not be formed by relying on support by defector. It sets a bad precedent and does not reflect the wish of the voters.

The 3 PR ADUNs probably have been forced to a corner. The concept of power sharing is often easier said than done.

After 308 election, I’ve written in my blog that after the victory, the PR government must learn how to manage power sharing.

The winner may want to enjoy the cake of their victory and it is the sharing of this cake that is the cause of friction among coalition partners.

BN has the advantage of a long tested module. It may have its weaknesses but it has withstood the test of time until the 308 election.

Earlier, when the 2 PR ADUNs were charged in court for corruption, it was alleged that it was a frame up by the government. Now that they are in BN, the court case will still proceed.

If they are found guilty after they have exhausted their legal avenue, they may have to vacate their seat. If this occurs 2 years before the next General Election, which is due in 2013, then a by-election may have to be called.

If BN loses these 2 seats, the BN government will then fall. However, if they are not found guilty, there will be a lot of speculation also that this is because of back door influence.

Either way BN government stands to lose by accepting these 2 ADUNs.

The PR MB should convey a general assembly and test whether he will get confidence of majority vote of ADUNs. If not, he should resign and dissolve the state assembly and call for fresh election.

Any demonstration is uncalled for. You’ll only aggravate the situation and if not properly managed, it often turns violent and is easily exploited to become racial.

This should be avoided at all costs.

It is often in crisis like this that the leadership is subjected to extreme pressure and we can see whether the leadership is a responsible one or an opportunistic leadership.

Clinging to the job will not be a honourable choice. The democratic thing is to let the state assemblymen decide.

However, in the present circumstances, if BN has simple majority in state assembly, it is unlikely that they will advise Sultan to dissolve state assembly and call for fresh election. The BN state government will then have to function with a simple majority from the support of the 3 Independents.

This may turn out to be the case when the minority calls the shot and be the power broker.

The rakyat may not look upon this power structure with favour. This high political drama will continue to drag for quite sometime.

The Perak rakyat do not need this political diversion when the country is confronted with the economic slowdown.

If the BN do a good job in this period, they may, in the long-term wins the hearts of rakyat. If not, BN ADUNs may be punished by the voters should fresh election be called within the state.

自安华在去年916夺取中央政权变天失败后,就流传着国阵与民联在玩同样的挖角游戏,有的说国阵议员将跳槽到民联,也有的说民联议员要过档国阵。

最后,是民联的州议员退党投向国阵,造成霹雳州政府倒台。

不论是州或联邦政权,都不能仰赖跳槽议员的支持來组政,这不仅立下一个极坏的先例,且无法充份反映霹州选民的意愿。

或许,这3名民联州议员是饱受严重打压,因为分享权力往往是说易行难。

308大选后,我曾在部落格中写道,胜选后民联政府必须要学习如何管理权力分享 。胜利者都想要分享胜利的蛋糕,但往往这个“分享”却是盟友间产生摩擦的导火线。

国阵的优点在于,它是一个经过长时间磨合与测试的组合,它或许存在弱点,但它毕竟是经过时间的考验,直至308大选。

稍早前,两名民联议员因贪污罪遭起诉,当时大家还斥责这是国阵政府设下的陷阱;如今虽然他们身在国阵,案件还是即將开审。

如果他们最终被判罪名成立,届时将丧失议员资格。这情况发生若在下届全国大选的前2年,即2013年之前,那么有关议席就必须有举行补选。

如果国阵输掉这两席,该州的国阵或会倒台;如果这两名议员最终获判无罪,那么也会出现各种揣测指这是幕后操纵审判的结果。

不论是何者,国阵都会因为招纳这两名议员而成为输家

因此,霹雳州务大臣应召开州议会,通过投票表决验证自己是否能得到多数州议员的信任和支持。否则,他应该辞职并解散州议会,重新举行州选举。 因此,没有必要展开任何示威或抗议,这样做只会使局势火上加油,如果沒有妥善管制,甚至会演变成暴力冲突及扩大成为种族课题。

任何人都应该要竭尽所能避免上述情况发生。

在诸类的危机中,领导层通常会承受庞大的压力,但我们也可从中看出这究竟是个负责任的领导层,或是投机者。

紧捉权位不放,并不是值得称誉的做法。民主,就是让人民來做决定。

然而,在目前情况下,如果国阵在州议会取得简单多数议席,就不太可能会寻求苏丹御準解散州议会重新举行选举。那么,国阵州政府将会靠3名独立州议员的支持以获得简单多数议席执政。 最终,这关键的少数票反而成为最有权说话的人。

人民不会喜欢或希望这种权力结构的产生,而这出政治大戏还会持续一段相当的时间。国家面临经济困境之际,霹雳州人民不会要这种政权转变。

如果国阵在这段期间表现得好,或许长期下來能赢回人民的心。否则,选民会在州选举时,用选票惩罚国阵的所有议员 。

truely benefited and enjoyed reading the article, good analysis covering all aspect.

In the end, BN is now given the chance to do something better and must be significantly feel by the people in Perak.This has to be done before the hearing of the two "YB" and before the next election. In any case, the sentiment is that PKR is now much more confidence to win the majority if the next election is to come sooner...the confidence came from the result of 308 and recent by-election.Not to mention the way BN get back the power.

Don't jump into the conclusion of PR State govt fall so fast!

We shall see in Court of Law as well Court of Public Opinion!

BN may win the battle for a moment but for sure lose the war!

There is no way for BN to win the hearts of rakyat Perak.

In votes, BN = 27 (Speaker has no vote), PR = 28, Indi = 2+1.

In case the woman double cross BN (possible 'cos the woman has no spine), the BN = 27+2, PR = 28+1.

Interesting, isn't it. Anyway, if BN does not change and PR can sustain the momentum for 4 years, BN Perak is finished in next election.

I will disagree with some facts made in this article. Crossover will not have a good ending – let’s review the history.

If BN to win back Perak according to the constitution, they will win with democracy. How difficult to wait for the state council meeting?

Integrity and loyalty is the fundamental of a politician, who knows, one day, what will happen. Like what Kuli and Dr M said – the impact of this is too big.

Win back the rakyat's heart, win back the votes and get back the government in a right way - remember, this will be in the history.

Dear Dr Chua,

With due respect of your comments, i should say that is well said and done. But again Dr.Chua, this drama in Perak would have not taken place if only the respective leaders representing their race would have voiced any disatifaction of the rakyat on the whole. Meaning, MCA, MIC, PPP, and other minority party has failed the people. UMNO has always have their way for far to long. I guess you and the rest knows it but yet again choose to ignore the facts put infront of you. So much for being for the rakyat, sad but true.

If BN did so to win the state government no matter how many sweets and development they did to the state will not win back the heart of Rakyat. Even opposition play an important role in order to guide the development of a government. Perak should not be the state being punished for what Datuk Anwar had done. The rakyat there are innocent. Pakatan till now had done quite a good job for the state. What BN need now is not about power.they should see farther. To win back the ppl heart. But I don think this will happen for the mean time unless much being corrected. Even MCA need to polish up their ideology and vision. Think twice before you act -- for our coming PM. Thanx!

We should mourn for what is happening in Perak. Democracy is death. BN is "raping" the prople of Perak by going against their will. What Hee Yit Fong and the other two ADUNs (currently being charged in court for integrity issue) have done will not be fofgiven by Perakians.

Do you agree with what Najib and his cronies have done to take over the control of Perak? What is MCA's stand? Support and welcome?

德川家康因为诚信,而得民心;季布因为“一诺千金”,所以获得侠义之士奔走说项。

换句话说,家康若不奉行诚信,民心离他远去,他的性命就如草芥一般,随时会遭杀害;季布若无诚信,空有能力,也无人愿意冒险挽救其性命。

诚信重如性命,它不但能保命,更能彰显生命的价值。是以,有诚信的政治人物,必定是能成大事,为民服务的贤能之士。

霹雳州在不到48个小时里面戏剧性的变化,让全国人民看了直傻眼。

这场政变掀开了马来西亚政治史黑暗的新一页,也改写308过后霹雳州的局势。无论民联或者国阵,在这场政变中都改变了他们的命运。

首先看看巫统,短暂来说巫统绝对是这次政变的大赢家,因为它一手主导整个过程,所以我们有理由相信在新政府上台后,巫统将可以分配到最充裕的政治大饼,包括从最底层的从新主导马来乡村的村长选举,各县、市议员以致市政局、市政厅主席的分配,到州属内各类基建工程、基建计划,统统都可以从新分配,以便达到可以利惠基层党员的目的。

回教党、公正党在霹雳州执政的十个月并不是坐在那里干等饭吃,他们的基层在这段期间已经深入乡区,尝试取代巫统的实力,或至少和地方上的巫统抗衡,接下来的胜利,可不是这么容易了。

至于整个政变最大的输家,肯定非马华莫属。

从308大选的结果,我们可以知道华裔的政治取向已经是绝对的倾向反对党(公正党、民主行动党)。308大选过后民联一系列对华裔有利的政策,如正式承认新村村长、拨出土地给州内的独中,以便他们可以以地养校、自给自足。这些政策让之前挺胸声称代表州内华裔争取权益的马华实在汗颜。

现在国阵(更恰当的应该说是巫统,马华只是在28席中占有一席,另加三个独立议员)执政后,我们都不敢打保单他拥有这么过人的胸襟继续执行民联之前定下有利人民的政策。这个对马华来说是一个政治死胡同,

如果改辕易辙,那不是显得马华还是一样的无能,还是一样唯唯诺诺的屈服于巫统的霸权。这种状况真是两手提篮——

左也难、右也难。未来的州立法议会选举,马华能不能保住仅存的一点血脉,诸难预料。马汉顺308大选所赢取的区区2000多张多数票,很可能就得一次过倒赔了。

在民联执政之下,华裔破天荒取得高级行政议员、另加5个行政议员和州议会副议长,和国阵时代马华和民政各分配得2个和1个行政议员的固打,政治势力和发言权实在不同日语。甚至连印裔也历史性第一次出任州立法议会议长。这种情况下,逻辑思考告诉我们,华裔和印裔在尝过甜头后倒戈回去马华、民政或国大党的可能性近乎等于零。

接下来的情况大概也可以看得到了——

马华接下来在华裔选区一定会兵败如山倒,在混合城市选区败走麦城的机会很大。概括以上论述,马华将会在来届大选中在霹雳州丧失仅余的政治版图。

You disappointed me this time - even you, the last MCA leader with an independent mind, has finally 'sold' himself out!

Your claim that the PR Govt don't know how to manage power-sharing is so typical of BN's opposition-bashing technique. Anyone or everyone worth two sen in BN can engage in this kind of simpleton argument or criticism.

I thought surely not the good Doc, but how wrong was I!

The real truth in Perak's PR Govt fall is not about the failure of power-sharing, it's about human greed, personal gain and personal interest. Doc, you know this, and every grown-ups in this country know this - so why not be honest with yourself and with those whom have much respect for you (in the past)?

Talking about demonstration - the right to demonstrate is a basic human right, recognised by all democratic countries in the world. You mean to say, Malaysia is not a democratic country? And Malaysians don't have a right to demonstrate?

Lastly, can you honestly believe or support the fact that the fate of the PR Govt in Perak - democratically elected by the people of Perak - should lie in the hands of just three persons (two of whom were tainted with corruption charges)?

Am I wrong, Doc, when I said I am truly disappointed with you this time?

SL, I concur with some of the comments that quoted you as saying that the PR does not know about power sharing. I was wondering whether you believe that UNMO truly knows about power sharing in BN. From time to time you sneaked in some soft timid comments about the way UNMO treated the other component parties in BN and you could not express your frustrations either.
The Perak constitutional crisis is a sad affair and the losers are not PR, but the people of Perak. I can only echo what Abraham Lincoln in his Gettysburg address :-
"Government of the people, by the people, for the people." Give back the mandate to the people, it is the rightful thing to do. A government not by the people will never be for the people.

Mr Chua, which MB you mean? Legal one or ilegal one?

Legal one has strong support by people, but not support by "powerful people".

So, the Legal MB is fighting for PEOPLE.

Or you mean, the ilegal one? Oh gosh, you must be kidding me?! A ilegal MB call for assembly meeting?

What is Role of M$A? Waiting money drop down from sky just like that foolish talk of Mr Mah (Same title with you one)?

It is interesting that you should finger Anwar Ibrahim for starting the frog jumping when in fact, BN has already done this before - in Sabah. BN does not come with clean hands.
What is pertinent is that the katak state assemblymen had signed resignation letters which was with the Speaker. Whether these resignations are valid should be heard in Court but natural justice has been denied by the Election Commissions hasty decision not to accept these resignations as valid.
The removal of the MB was unconstitutional. That is a fact which many other learned men of law have already analyzed in various other blogs.
Under such clouded circumstances, it would only have been appropriate that the mandate of deciding who should rule Perak should have been given back to the Rakyat.
On this basis, I humbly submit that in the Court of Public Opinion, BN have grabbed power through undemocratic means and no amount of justification by anyone associated with BN will change the public's perception.
BN may have won back governance of the State, but it has not won the hearts of Perakians and few in the State will consider it a valid government.
BN and will reap what it sows.

The BN component parties performance in the 308 GE was a direct consequence of BN's concept of power sharing.

The Rakyat have said it loud and clear - the long tested model of BN's concept of power sharing has been rejected.

Quite frankly, I'm tired of politics and national policy set along racial lines - as has been adopted under the BN power sharing concept.

When an indian muslim or 2nd generation indonesian has more "rights" than a 5th generation Malaysian, something is wrong with the power sharing formula. MCA, MIC and Gerakan have failed with BN.

Dear Dr. Chua,

I don't agreed with the way of BN take over Perak, and also the 4 jump from the PKR. It is a shame to all the Malaysians. However, the PKR also need to think about why the 4 jumped to BN? There must be a reason there beside of $ issue. Hope that everything will settle soon as there are more important problem waiting for the government to solve.

Dr Chua,

Grabbing power is unethical and not on high moral grounds. Hence BN and UMNO is doing this illegally. You should not support such nonsense.

Just as Tee Keat is sidelining you which is not ethical as you won the Deputy President legally from the MCA General Assembly and he should respect the wishes of the delegates.

So in the same manner, BN should accept the wishes of the rakyat.

I share the feeling of most of the bloggers that MCA and some Gerakan leaders are playing "Tai Chi" when come to this issue. They either remain silent or accusing Anwar for "staring it first" (indirectly saying this initiated by Najib is a legitimate one since Najib is not the one started it??)

When Anwar was coming out with the plan to topple the federal government, many MCA, Gerakan leaders were condeming him for doing this. Now UMNO is robbing the people's right by toppling the legitimate PR government. Nobody is condeming. This is the usual submissive to UMNO's MCA and Gerakan??? I expect you to speak out with conscience, but you have dissapointed us this time. The President, OTK who is portrayed as high moral, ethic person is silent on this issue. I think the toppling of Perak state government is not only about the collapse of PR led state government, it is about the constitutional right of the people is being "robbed". Why our leaders silent on this?? Why the double standard??

Only Lim Si Pin form Gerakan(son of Lim Kheng Yaik)did comment with his conscience: "You are cheating the people as you think the voters are stupid. You are the representative of the people, how can you defect so easily. This is an abuse of the democratic process."

I quote some responses from the bloggers:
"Funny. Gerakan and MCA is now being selective again. Such claims that current hopping is FINE because Anwar initiated the idea of it. Legitimizing something which is illegitimate based on such reason?"

"Consistency is the hallmark of a principled statesman. If one is critical of Anwar Ibrahim trying to use the back door to seize government, then one must also condemn the UMNO led initiative to take the Perak state government via the back door."

Based on the above, do you think MCA has changed to a more critical, dependable, trustable, always fighting for the rights of people or usual submissive to UMNO's BN component party???

民聯實權領袖拿督安華衣佈拉欣最近有說過民聯不急於為他制造補選以讓他能當選 為國會議員. 因为民聯當急之務是要槁好由民聯所執政五個州的經濟及行政。不過從 安華向國陣議員所作出的信息來看﹐很明顯的他有很强烈的的意願要成立由民聯所領導的中央政府。成立由
民聯所領導的中央政府﹐理論上是可能的﹐因為只 要有超過三十位來自國陣的人民代議跳槽到民聯﹐民聯就可執政馬來西亞但我們有需要關注的是在這種情況產生的政府是否穩定﹐遊說國陣的人民代議跳槽 到民聯有否違背選民的意願。 現在馬來西亞人民已經給民聯機會在五個州執政﹐他們應該以實際行動向人民證實他們的诚心及實力。由民聯所執政五個州的四個州是主要的稻米生產的地方。民聯何不把握機 會協助這四州的農民增加稻產﹐使我國能達至白米自供自足的目標。
前槟城州政府已向联合国教科文组织提呈报告书,申请当地古迹列为世界文化遗产。林冠英首長必须对这申请有跟追,使檳城州被聯合國文教組織列為古籍城市,循著這個優勢進一 步發展檳城州的觀光業以惠及檳城州的人民。 雖然我和民聯的代議士是來自不同的陣營﹐我也沒有把他們當為不共戴天的敵人。 我希望民聯人士不能單單想要執政而已﹐也要為國家及人民的前程着想。 所作出的行動及言論都有顧慮到國家的穩定。

政黨的結盟也有關乎到原則
筆者:物和好 (吳和豪) 務邊的國會議員李文才醫生最近有提議馬華公會總會長拿督斯理黃家定跳槽至民聯。我反對這
提議因為1)政黨的結盟不應以奪取政權作為起點。我們目前應把重點放在解決物價高漲,確保有足夠的糧食及工作機會而不是推翻當今的政府。民聯如果還是一味急著要奪取政權不會對解決民生問題有任何幫助反而只能制造不穩的局勢使到人民不能集中精神于生產及投資因而影響了國家的發展進度。
2)政黨的結盟也有關乎到原則,回教黨主張建立神權國而馬華公會反對這建一點。所以馬華
公會沒有可能加入民聯。馬華公會當初與巫統,印度國大黨結盟是為了爭取嗎來西亞獨立,及建立一個多元文化多元種族的馬來西亞社會。 
3)民聯的公正黨顧問拿督斯理安華整天唯恐天下不亂,到處破壞國家名譽,干涉鄰國內政,馬華公會也不會認同他的舉動。因為我們認為與鄰國維持良好關系是非常重要的,因為這將助于國與國之間的文化交流及經貿合作。從而促進區域的安定及繁榮。
4)馬華公會也不贊同民聯人士的街頭示威,以身試法,因為這是不文明及沒有顧慮到公眾安全的舉動。基于以上幾點,我堅決反對李文才醫生作出的提議。

日前槟州首长林冠英有说,许月凤可以有上千万种理由离开行动党,但不该背弃人民支持民联的意愿,否则将如吴三桂引清兵入关般,成为历史罪人而被后人遗弃。
林冠英首长也有说有说吴三桂的后人不敢认是三桂为后人。本人认为林冠英作为一
州之长, 不能一时之怒,而作出其主观及误导性的言论。
本人姓吴祖籍福建同安马巷。对于林冠英首长所说吴三桂的后人不敢认三桂为后人不敢认是三桂的后人本人就不认同。我已故的源意堂伯承经告诉我在我们福建同安马巷的祖屋前挂有一对大灯笼是由皇帝斯给吴三桂,我们族人一直都非常重视这对大灯笼因为我们认为吴三桂是智勇双全的孝子。

大明王朝的灭亡的主要原因不在于吴三桂而是在于其他客观的原因。
引清兵入关,背叛大顺政权也 未必是一件坏事,因为大顺的确给
地方的人民带来许多的痛苦。我们也不能再以汉族的身份来评论中国清朝历史,因为汉族与满族早已是一家了。
请林冠英首长不要再作出其主观及误导性的言论,而应该把更多的精神来解决及改进民生问题

A group of thieves is trying to steel a bell. Afraid that people may be aware of their act so they cover both their eyes and ears thinking people cannot see nor hear.

When the villagers heard the bell ringing, they rush out from their house only to face a wall of tear gas. One tear gas fell on a ten-year-old innocent boy, the father carrying him crying helplessly & looking towards the sky and asks for help. ….

Oh Almighty gods would you help these helpless villagers to recover the bell that rightfully belong to by them…? !

What could make the Perakian expect the new BN formed government to perform better after 51 years of Umno hegemony?
The Chinese community at large has woke up to the occasion, that PR will performed much better.
Dr. Chua ever gave applause to the free hold land title to Kampung Baru folks, which MCA never accomplished. And MCA will continue to claim represents the Chinese under UMNO shadow!

Don't you have any shame, always wanting to stand on the moral high ground and talk about principles, when you don't have any?

It's a shame you support an illegally formed state government despite the fact that its Chinese participation in the government has been decimated to a miserable one.

What you prefer is one Chinese from MCA to 18 Chinese from the DAP?

Personal interests supersedes community interest, eh? Perhaps you also close your eyes and ears to the blatant trampling of democracy and rule of law by UMNO?
MCA is not worth anything if it cannot even defend democracy.
Can't you see MCA's total subservience to the arrogance and might of UMNO.
Mark my words. BN and MCA will be annihilated in the next general elections. You have sold out the Chinese in exchange for personal glory. Bring your glory to your graves.

The philosophy of legitimacy — The Malaysian Insider
FEB 11 — He does not get it. Legitimacy cannot be bestowed by royal decree or through the dishing out of generous handouts or even by occupying top political office.

Heck, even Zimbabwe's strongman Robert Mugabe knows that winning a rigged election cannot buy him the precious commodity called legitimacy.

But Perak's newly-installed Menteri Besar Datuk Dr Zambry Kadir does not get it. He snapped at troublesome journalists asking troublesome questions today.

When asked if he had the support of the majority of Perakians, he became defensive. When the reporter pushed further and pointed out that he and Barisan Nasional did not wrest control of the state legislature through an election, he fired back: "What do you mean? This is a democratic process. Do you understand democracy? I am asking you, do you understand the political philosophy of democracy.''

The reporter did not reply and stoke the fires of confrontation. Zambry is a likeable chap but he is deluding himself if he believes that the voters of Perak are interested in what Rawls and Weber have to say about the philosophy of demoracy.

He is on more dangerous ground if he believes that Barisan Nasional is guaranteed legitimacy by virtue of being participants of the swearing-in process in Kuala Kangsar and the soiled motives of Pakatan Rakyat in triggering the defection dance.

Something only becomes legitimate when someone approves of the action. In a democracy, approval is given when the government is subject to the will of the people and when proper processes and procedures are followed.

These important ingredients have been missing in Perak. When the Sultan of Perak directed Datuk Seri Nizar Jamaluddin and the Pakatan Rakyat state government to stand down in favour of Barisan Nasional, he may have been exercising what he considered his rightful constitutional powers.

But the ensuing public debate on the correctness of his action suggests that many Perakians do not believe that the process was followed.

The fact that BN did not have the opportunity to test its popularity at the ballot box has also hurt its legitimacy in the eyes of some voters. This is something that Zambry should understand quickly.

And as Ivo Daalder of Brookings Institution said: "Legitimacy is not a luxury for the powerful and a necessity of the weak. It is what's necessary to translate power into success.''
